Access to this website is permitted on a temporary basis, and we reserve the right to withdraw or amend our services without notice. We will not be liable if for any reason this website is unavailable at any time or for any period.

This website also contains links to other websites, which are not controlled by us and we accept no responsibility for them or for any loss or damage that may arise from your use of them.

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. THE ABAYA COMPANY shall not be liable to any person for any loss or damage, which may arise as a result of any failure by you to protect your password or account.

 

ONLINE STORE TERMS
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the service, violate any laws, including but not limited to copyright laws. You may not transmit or distribute any viruses, worms or trojans or any code of a destructive nature that is technologically harmful. You may not post any material that is offensive or obscene; cause annoyance to other users; post any unsolicited promotional or advertising material. A breach or violation of any of the terms will result in an immediate termination of your services and will be reported to the relevant law enforcement authorities.

You are not permitted to publish, manipulate, distribute or copy in any format, any of the content appears on the website or was sent out to you nor may you use any such content in connection with any business or commercial enterprise.

 

ERRORS AND INACCURACIES OF INFORMATION
We try our best to ensure that information on this website, including product descriptions, prices and promotions are accurate and correct at all times.  However, mistakes do happen. In this case we will try our best to resolve the error as soon as it is possible and if we believe that this error could have affected your purchase in any way you will be informed. We will however not be held liable to you for any errors or mistakes on the website. 

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

PRICES AND AVAILABILITY
All our product prices are subject to change without prior notice.  We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service. Delivery costs will be an additional charge, and will be stated clearly during the order process and included in the ‘total’ cost. The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. 

Products ordered for delivery outside the UK may be subject to import duties and taxes, which are levied when the delivery reaches its destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

 

PRODUCTS
When shopping online please be aware that buying clothes over the internet provides a different shopping experience to buying it in store.

Although we have made every effort to display as accurately as possible the colours and images of our products, we cannot guarantee that your monitor's display of any colour will be accurate and therefore we cannot be held responsible for colour discrepancies as a result of that.

All sizes and measurements provided for the products are approximates, but as accurate as possible with variations of up to 1 inch.

 

ALTERATION SERVICE
As part of our services we offer alteration services, which can be purchased separately. You will need to provide us with the required measurements that the garment has to be altered to. We can provide you with as much details as possible to assist you when taking the measurements, however we cannot be held responsible to any errors in measurements taken by you and therefore incorrect alterations. Please double check the measurements provided to avoid disappointment. Any items, which require alteration, cannot be returned or exchanged.

 

QUALITY AND CARE
We pride ourselves in the quality and finishing of our products and all of our items must pass a thorough quality checking process before they are deemed suitable for retail. However in the unlikely event that you receive a damaged product, please email us within 48 hours at info@the abayacompany.com with a picture of the damage and more information and we will resolve the matter as soon as possible.

In the unlikely event of a manufacturing defect to the product, please email us at: info@the abayacompany.com with adequate information and evidence of the defect i.e. pictures and proof of purchase. A member of our team will investigate the matter further to conclude whether it was a genuine manufacturing defect or a result of poor use, lack of care or general wear and tear which unfortunately we cannot be held responsible for. Such issues can only be resolved if you contact us within 14 days of purchase.

We have provided you with enough information regarding the care of your product, where possible. If however this information has been left out please email us at info@theabayacompany.com and we can provide that for you. We cannot be held responsible for damage caused by not following the provided care instructions. For example, some of our abayas contain sequencing that has been hand stitched and must be handled with extra care and dry cleaned only.

 

ACCURACY OF BILLING AND ACCOUNT INFORMATION
You are responsible for providing us with up-to-date and accurate purchase and account information, including email address, delivery address and credit card details for us to successfully process your purchase and contact you if necessary.

 

PAYMENT INFORMATION
We accept payments from all major credit and debit card providers, as well as payments through Paypal. By completing your payment details you confirm that the credit or debit card being used belongs to you. We do not store any credit card details that are provided for payment purposes. All payments are made through a secure encrypted server for optimal security.

 

ACCEPTANCE OF YOUR ORDER
We must receive full payment both for the price of the goods and any delivery charges before we can accept any offers. Once your order has been completed you will receive a confirmation email regarding the order. This however does not mean your order has been accepted on our behalf and we still reserve the right to cancel the order. We have only accepted your order once the items have been dispatched to you. Only the goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

 

DISCOUNT CODES
Discount codes may be offered to account holders from time to time. To be redeemed when purchasing goods online. Only the account holder to which it was sent can use these. Only one discount or promotional code can be used at a time.

 

LIMITATION OF LIABILITY
In no case shall The Abaya Company, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

 

SEVERABILITY 
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
